Summer Classics/Gabriella White resolves lawsuit against Costco

PELHAM, Ala. — A year-long lawsuit between , a family of furniture and décor brands that includes Summer Classics, Gabby and Wendy Jane, and has been resolved, effective April 10.

The lawsuit for design patent infringement and trade dress infringement against Costco, a multinational membership-only retail outlet, enforces ’s patent and intellectual property rights in response to Costco’s sale of low-cost, replica outdoor seating collections. The lawsuit, filed on April 24, 2023, in the U.S. District Court of the Western District of Texas in the Waco Division, was settle amicably with Costco, and the membership retailer agreed to cease sale of the disputed product and provide a payment of an undisclosed amount to Gabriella White.

Summer Classics was established in 1978 by White. With a legacy spanning over 35 years, Gabriella White manufactures luxury furniture and accessories.

Furniture Today reached out to Costco, which had no comment.
